Terms of Service
These terms govern your use of Sitewise (“the App”) and the sitewise.com.au website (“the Site”), both operated by Hani Motassam, ABN 69 141 033 204 (“Sitewise”, “we”, “us”).
By downloading, installing, or using the App, you agree to these terms. If you don't agree, don't use the App.
1. Licence
Subject to these terms, we grant you a limited, non-exclusive, non-transferable, revocable licence to install and use the App on Apple-branded devices that you own or control, in accordance with Apple's Standard EULA for App Store apps.
The App is licensed, not sold. We retain all intellectual property rights in the App.
2. Your inspections, your data
You retain ownership of all content you create using the App — inspections, photos, reports, and any data you input. We claim no rights over your content.
Because the App stores your data on your device rather than on our servers, you are responsible for backing it up. We recommend you periodically export reports and back up your device using Apple's built-in tools (iCloud Backup or encrypted local backup via Mac).
We are not liable for any loss of data resulting from device failure, theft, accidental deletion, or any other cause.
3. Acceptable use
You agree not to:
- Reverse-engineer, decompile, or disassemble the App except as permitted by applicable law
- Use the App in any way that infringes the rights of others
- Attempt to circumvent the App's free-tier limits other than by purchasing a subscription
- Use the App to produce reports that are knowingly false or misleading
- Use the App in any way that violates Australian law or the laws of your jurisdiction
4. Subscription terms
4.1 Free tier
The App is free to download and use. The free tier provides unlimited inspections and photos, with a limit of three (3) report exports per calendar month. Reports generated on the free tier include a watermark and do not include your custom branding.
4.2 Pro subscription
The App offers an optional “Pro” subscription (“Sitewise Pro”) at the following prices in Australian Dollars:
- Monthly: A$14.99 per month
- Annual: A$119.00 per year
Prices may differ by region; the current price is displayed in the App at the point of purchase.
4.3 Free trial
The annual plan includes a 7-day free trial for new subscribers. During the trial, you have full access to all Pro features. If you do not cancel before the end of the trial, your subscription will automatically convert to a paid annual subscription and you will be charged the annual price.
4.4 Auto-renewal
Subscriptions automatically renew at the end of each billing period unless you cancel at least 24 hours before the period ends. Renewal is charged to your Apple ID payment method.
You can manage and cancel your subscription in your iPhone's Settings → [your name] → Subscriptions, or via the App Store. Cancelling stops future renewals; you retain Pro access until the end of the current period.
4.5 Refunds
Apple is the merchant of record for App Store purchases. Refunds are handled by Apple in accordance with their policies. Request a refund at reportaproblem.apple.com.

4.6 Price changes
We may change subscription prices in the future. Existing subscribers will be notified by email and through the App before any price increase takes effect. Apple requires explicit consent before raising prices materially; small adjustments may renew automatically subject to Apple's policies.
4.7 If your subscription expires
When a Pro subscription ends (cancellation or payment failure), your account reverts to the free tier. You retain all your existing inspection data and previously-generated reports. New reports will be subject to the free-tier limits and watermark.
5. Disclaimer about inspection content
Sitewise is a tool for documenting and formatting inspection reports. It is not a substitute for professional judgement. The accuracy, completeness, and legal validity of any inspection report you produce using the App is your responsibility.
Sitewise does not perform any inspection of any property, does not provide professional advice, and is not liable for the content of any report you generate. You are responsible for ensuring that the reports you produce comply with the relevant Australian Standards (such as AS 4349.1-2007 for residential pre-purchase inspections), the National Construction Code, and any applicable licensing or professional indemnity requirements in your state or territory.
6. Sample templates and disclaimer text
The App includes sample defect templates and disclaimer text as a convenience. These are provided as starting points only, not as legally vetted documents. You are responsible for reviewing and customising any disclaimer or boilerplate text before sending a report to a client.
7. Updates
We may update the App from time to time to fix bugs, add features, or comply with platform requirements. Some updates may require an iOS version that's newer than your current device.
8. Termination
You can stop using the App at any time by uninstalling it and (if you have a subscription) cancelling it through Apple.
We may suspend or terminate your access to Pro features if you materially breach these terms. We have no ability to prevent you from using the free tier of the App offline.
9. Warranties & consumer guarantees
Our goods and services come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure and to compensation for any other reasonably foreseeable loss or damage. Nothing in these terms attempts to exclude or limit those guarantees.
Subject to the above, the App is provided “as is”. We do not warrant that the App will be error-free, that all bugs will be fixed, or that the App will work uninterrupted on every device or iOS version.
10. Limitation of liability
To the maximum extent permitted by law, our total liability to you for any claim arising out of or in connection with these terms or the App is limited to the amount you have paid for the App in the 12 months preceding the claim (which, for free-tier users, is zero).
We are not liable for indirect, consequential, or special damages, loss of profits, loss of business, or loss of data, even if we have been advised of the possibility of such damages.
11. Governing law
These terms are governed by the laws of New South Wales, Australia. You and we submit to the non-exclusive jurisdiction of the courts of New South Wales.
12. Apple-required terms
These terms are between you and Sitewise, not Apple. Apple is not responsible for the App or its content. In the event of any failure of the App to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any). To the maximum extent permitted by applicable law, Apple has no other warranty obligation whatsoever with respect to the App.
Apple and Apple's subsidiaries are third-party beneficiaries of these terms, and upon your acceptance, Apple has the right to enforce these terms against you.
13. Changes to these terms
We may update these terms from time to time. The “Last updated” date will reflect the most recent change. Material changes will be notified through the App and by email to subscribers.
Continuing to use the App after a change means you accept the updated terms. If you don't accept them, your remedy is to stop using the App and (if applicable) cancel your subscription.
